1. Introduction
Welcome to PodcastProducer.com. These Terms and Conditions ("Terms") govern your use of our website and services. By using our services, you agree to these Terms. If you do not agree, please refrain from using our services.

2. Services Provided
PodcastProducer.com offers a range of podcast production services, including but not limited to:

• Podcast branding

• Editing

• Hosting

• Consulting

Please note that PodcastProducer.com specializes in providing podcast production services tailored for clients with a global marketing strategy where their podcast plays an important role. While we support aligning your podcast with this strategy, the execution and management of broader marketing efforts remain the client’s responsibility. We offer limited social media posting options but do not act as social media managers. Consequently, the growth, engagement, and overall management of your social media accounts and podcast are aspects that clients are expected to handle independently. However, if you would like additional support in these areas, we would be more than happy to discuss a separate agreement tailored to your needs.

3. User Responsibilities
Clients are responsible for:

• Recording podcast episodes and submitting them according to our turnaround time. 

• Extracting and uploading raw files to the designated drive at least 7 days before the expected delivery date.

• No modification of the release schedule will be made unless the client notify PodcastProducer.com at least 7 days in advance

• Providing accurate and compliant information for show notes and posts.

• Ensuring that all content (including music, video, and other assets) does not infringe on any copyrights and does not contain illegal or offensive material.

• Providing all necessary logins and access credentials to PodcastProducer.com in a timely manner. Delays due to failure to provide this access are the client's responsibility.

• Providing high-quality raw footage that considers factors such as lighting, sound, framing, and overall podcast performance. PodcastProducer. Com is not responsible for the end result of a bad RAW file provided bad the client.

4. Payments and Refunds
Payments are primarily processed through PayPal, with other payment methods considered upon request.

• Clients have a 5-day grace period to make payments. After this period, services will be temporarily suspended, and a $250 fee will be charged to reinstate the service.

• No refunds will be provided if the client decides to terminate the service prematurely.

• Services are billed on a monthly basis as outlined in the contract. Payments are due between the 1st and 5th of each month for services to be rendered that month. If payment is not received by the 5th, services will be suspended until payment is made. If no payment is received by the 15th and the client wishes to reinstate services, a $250 reinstatement fee will be applied in addition to the monthly service fee.

5. Intellectual Property
All intellectual property rights related to the podcast content produced are, in most cases, owned by the client. PodcastProducer.com does not claim any ownership rights unless a separate agreement is negotiated. If a different arrangement is desired, this must be discussed and agreed upon in writing prior to the commencement of services.

6. Liability and Disclaimers

• Liability: PodcastProducer.com will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our liability is limited to the amount paid by the client for the specific service in question.

• Disclaimers: We disclaim any responsibility for the quality of audio or video content that is affected by the source material provided by the client. Additionally, we are not liable for any content-related legal issues, including copyright infringements or other legal issues related to the client's content.

7. Termination of Services

• If payment is not received within the 5-day grace period, services will be suspended. Reinstatement will require a $250 fee.

• The client is responsible for maintaining their own backups of their content. While PodcastProducer.com provides access to our drives, we do not manage or transfer client content. No refunds will be issued if the client decides to terminate the service after payment is made.

8. Privacy and Data Protection

• We collect contact information from guests to streamline workflows when they are re-invited to a podcast show.

• Data Protection Compliance: Based in Barcelona, Spain, we comply with the General Data Protection Regulation (GDPR). Clients and guests have the right to access, correct, or request the deletion of their personal data.

9. Jurisdiction and Governing Law
These Terms are governed by the laws of Barcelona, Spain. As the headquarters of PodcastProducer.com are located in Barcelona, we fall under the jurisdiction and governing laws of both Spain and Catalonia. Any disputes arising from these Terms or the services provided by PodcastProducer.com will be subject to the exclusive jurisdiction of the courts in Barcelona.

10. Modifications and Updates
We reserve the right to modify these Terms at any time. Clients will be notified of any changes via email and an update on our website. Continued use of our services after such changes constitutes acceptance of the new Terms.
